1. Who we are

Swamarg ("Swamarg", "we", "us") is a product of Shivya Technologies Private Limited ("the Company"). These Terms & Conditions ("Terms") govern your use of the Swamarg website, mobile application, and related services (together, the "Service"). By using the Service, you agree to these Terms.

2. What Swamarg is

Swamarg is a destination guide for Indian pilgrimage and heritage cities. It surfaces curated places, AI-drafted narrative content, and connections between places (such as circuits and nearby sites), and lets business owners create free self-listings.

3. AI-drafted and third-party content

Some content on Swamarg — city descriptions, narrative sections, local markets, notable people, and similar text — is drafted by an AI model from general or public sources and may contain mistakes, outdated details, or claims that don't hold up to scrutiny. Where a page marks something as AI-drafted, treat it as a starting point, not a verified fact, and double-check anything time-sensitive (timings, prices, availability) before relying on it. Content explicitly marked "Verified" has independent corroboration (an official source, or a fact we have personally checked) but is still provided on an "as is" basis with no guarantee of continued accuracy.

4. Business listings

Business owners may create and publish a free listing for their establishment. Listings are self-declared by the business owner, not verified or endorsed by Swamarg, and are shown separately from Swamarg's own curated, editorially-sourced content. Swamarg does not currently charge for creating or publishing a listing; pricing or paid placement, if introduced in the future, will be communicated before it applies to you. We may remove a listing that is inaccurate, misleading, or violates these Terms.

5. Partner & advertise inquiries

Submitting a partner or advertising inquiry only records your interest for us to follow up on. It is not a purchase, order, or binding commitment, and no payment is collected at that step.

6. Your use of the Service

You agree not to:

• Use the Service for any unlawful purpose or in a way that violates any applicable law or regulation.
• Submit false, misleading, or fraudulent information in a business listing or partner inquiry.
• Attempt to disrupt, overload, or gain unauthorized access to the Service or its underlying systems.
• Scrape, republish, or resell Swamarg's content at scale without our written permission.

7. Location and device data

Features like "Near me" and distance-based results use location you explicitly share through your browser or device permissions. We use it only to serve that request (e.g., ranking places by distance) and do not sell your location data.

8. Intellectual property

The Swamarg name, logo, and app design are the property of the Company. Curated content, narrative text, and data compilations on Swamarg are owned by the Company or licensed to us; you may view and share individual pages for personal, non-commercial use, but may not systematically copy or redistribute the underlying dataset.

9. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We do not guarantee that any place, timing, price, or fact shown will be accurate, complete, or currently available — always verify time-sensitive details independently, especially before traveling.

10. Limitation of liability

To the maximum extent permitted by law, the Company will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service, including reliance on any content, listing, or inquiry submitted through it.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after an update means you accept the revised Terms. We'll update the "Last updated" date above whenever they change.

12. Governing law

These Terms are governed by the laws of India, without regard to its conflict-of-law principles.
